China Tightens Drone Export Controls: What Foreign Founders Need to Know
China's Ministry of Commerce, General Administration of Customs and Central Military Commission Equipment Development Department issued Announcement No. 49 of 2026, optimizing and adjusting export control measures for certain unmanned aircraft items. Foreign founders operating in China should review whether their products or technologies fall within the listed categories before exporting.
China Adjusts Export Controls on Unmanned Aircraft Items
China's Ministry of Commerce, the General Administration of Customs, and the Central Military Commission Equipment Development Department jointly issued Announcement No. 49 of 2026, setting out optimized and adjusted export control measures for certain unmanned aircraft-related items. The announcement was approved by the State Council and the Central Military Commission and takes effect under China's Export Control Law, Foreign Trade Law, Customs Law, and the Regulations on Export Control of Dual-Use Items.
For foreign founders whose China-based companies make, source, or ship drones, drone components, or related technology, the announcement is a practical compliance checkpoint. Items meeting the listed characteristics cannot be exported without a license.
Which Items Are Covered?
The announcement identifies specific controlled items by control-list code and, in many cases, by reference customs commodity numbers. Founders should map their product lines against these categories carefully.
Autopilots and Complete Aircraft
- 7A103.b covers autopilots specially designed for unmanned aircraft (reference customs number 90142010.10).
- 9A012.a covers unmanned aircraft or unmanned airships capable of controlled flight beyond the operator's natural line of sight, with specified characteristics. One listed threshold is a maximum endurance of at least 30 minutes but less than 3 hours, together with the ability to take off and fly in a stable, controlled manner in gust conditions of 46.3 km/h (25 knots) or above. A long list of reference customs numbers accompanies this entry.
Engines and Propulsion
The announcement also addresses certain engines, including reciprocating piston or rotary internal combustion engines specially designed for flight above 15,420 m (50,000 ft), aero engines with maximum continuous power exceeding 16 kW, and turbojet engines with thrust of 400 N or more. Reference customs numbers are listed for each category.
Communications Equipment, Motors, ESCs and Blades
- 9A012.e covers radio communication equipment specially designed for the unmanned aircraft or airships controlled under 9A012.a and meeting specified characteristics.
- 9A112 addresses unmanned aircraft not controlled under 9A012, including brushless motors specially designed for drone propellers, electronic speed controllers designed to pair with controlled items, and carbon-fiber composite blades with specified features.
- 9E902 covers technology for the development, production, or use of items controlled under 9A012.b, 9A012.c, 9A012.d, 9A012.e, and 9A901.
Definitions Founders Should Note
The announcement defines several terms used in the control criteria. "Operator" refers to professionals responsible for controlling the aircraft or airship through a ground control station, whether by remote control or programming. "Endurance" means flight time converted to International Standard Atmosphere conditions (ISO 2533:1975) at sea level with zero wind. "Natural line of sight" refers to the maximum distance at which an observer on the Earth's surface can clearly see an object under ideal conditions without human interference or atmospheric pollution, recognizing the practical influence of atmospheric conditions.
Licensing and Customs Procedures
Exporters of the listed items must apply to the competent commerce department of the State Council for a license under the Export Control Law and the dual-use items regulations.
Exporters are responsible for the accuracy of customs declarations. Where a product falls within the announcement, the exporter must declare its characteristics and related indicators and note "subject to export control" in the remarks column of the customs declaration form. Where a product is not listed but its characteristics are close to the thresholds, or where its end use falls outside the listed situations but other indicators match, the exporter must declare the relevant information and note "not subject to export control." Customs may question the accuracy of declarations and will not release goods during the questioning period.
Facilitated Export Channels
The announcement provides several practical routes for exporters.
- For items controlled under 9A012.a.1, exporters may self-export after obtaining an export certificate through registration and information filing before each shipment.
- For items controlled under 9A012.a and 9A112 used at exhibitions held in China (excluding defense and police exhibitions) and returned unchanged to the original place of export immediately after the event, or at exhibitions outside China (excluding defense and police exhibitions) and returned unchanged into China immediately afterward, exporters may use the same registration-based certificate route before each export.
- Exporters that have established and effectively operate an internal compliance system for dual-use item exports, with relevant export records and relatively stable export channels and end users, may apply for general licenses and other facilitation measures in accordance with the law.
Practical Steps for Foreign Founders
Founders should first classify products and technologies against the control-list codes and reference customs numbers. Second, review customs declarations to ensure the remarks column is completed correctly. Third, document end uses and end users, particularly for exhibition shipments. Fourth, consider building a dual-use export compliance system, which can support access to general licensing. Finally, confirm licensing requirements before each shipment, because the announcement requires permission before export.
The announcement is dated October 19, 2026.
